1. License grant
BoekSolutions grants the user a non-exclusive, non-transferable and revocable right to install and use the software in accordance with the purchased license form. The license can, depending on the order or agreement, be issued per user, per workstation, per organisation or on any other basis agreed in writing. The software is licensed, not sold.
2. Permitted use
The user may use the software solely within their own organisation and for internal business operations. Within the limits of the purchased license the user may:
- install the software on employee workstations;
- use the software for internal business processes;
- make necessary backups of installation files and license data;
- install updates the user is entitled to.
3. Prohibited use
The user may not:
- redistribute, resell, rent, lend or sublicense the software to third parties;
- copy the software in whole or in part, other than for permitted internal use or backup purposes;
- reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, except where mandatory law permits;
- modify or create derivative works without written consent of BoekSolutions;
- share license codes, activations or credentials beyond the permitted license limits;
- circumvent technical protections, activations or license checks.
4. Ownership and intellectual property
All intellectual property rights in the software, documentation, designs, source code, trade names, logos and related materials remain with BoekSolutions or its licensors. The user only obtains the right of use described in this agreement. No ownership rights are transferred.
5. Updates and new versions
BoekSolutions may release updates, improvements or new versions. When the purchased license includes an update subscription or maintenance period, available updates are provided during that term. BoekSolutions is not obliged to release updates unless expressly agreed in writing.
6. Support
Support, installation help, customisation, bug fixes or advisory services are only provided when agreed in writing or included in the purchased license or agreement.
7. Beta software
Beta, test and trial versions are provided "as is" and are intended for evaluation, demonstration or testing. These versions may contain errors, limitations or incomplete features. Use in production environments is entirely at the user's own risk. BoekSolutions is not obliged to provide support on beta, test or trial versions unless agreed otherwise.
8. Termination
In case of breach of this agreement BoekSolutions may suspend or terminate the right of use immediately. After termination the user must remove the software from all systems on which it is installed and stop using license codes or activations. Termination does not give rise to a refund of amounts already paid, unless agreed in writing or required by mandatory law.
9. Liability
For liability, warranties, limitations and other terms please refer to the Terms and Conditions of BoekSolutions. In case of conflict between this software license agreement and the Terms and Conditions, this agreement prevails to the extent it specifically concerns use of the software, unless agreed otherwise in writing.
